Should the family delay relocation while the project is still raising capital?

THE DIRECT ANSWER

Project financing status does not create immigration status, so relocation cannot depend on it. A pending petition confers no work or travel authorization for the investor or for a spouse and unmarried children under 21. Plan any move around the immigration milestone that actually permits it, not around a construction start date.

Anchor household plans to status, not to the site

Write down for each family member their current nationality, any existing U.S. status, and what they intend to do on arrival — study, work, or neither. A spouse who needs to work should have that route assessed independently.

Where a child is approaching 21, ask early how the process interacts with age, since protection is fact-specific. Sponsors' timelines slip; the family's schooling and employment decisions should not be hostage to them. Add one further household task that a slipping project schedule makes essential: identify the decisions that must be made by a fixed date regardless of the project's progress, and take them on their own merits.

A school application, a lease renewal, a professional registration, a business decision abroad — each has its own deadline and none of them will wait for a construction programme. Listing them separately prevents the household from postponing everything in the hope of clarity that may not arrive. Hypothetical example: a family with a child approaching a university decision finds that the decision cannot be deferred to await a project milestone, and taking it independently turns out to be both easier and better than the alternative of holding everything open.
