Define the process, not the job title

Begin with the production process itself: what it makes, which equipment and parameters it depends on, how it differs from a general industry method, and why the receiving site cannot simply follow published practice. Specialised knowledge here concerns the company's own products, techniques, or equipment, or an advanced level of knowledge of its processes and procedures. A description that could apply to any plant in the sector will not carry the case, however accurate it is. Write the process description in a form an engineer from another company could not have produced from public sources. Name the sequence, the control points, and the failure the sequence exists to prevent. Then ask a colleague outside the department to read it and mark every sentence that would be true of any plant in the sector; those sentences are doing no work in the file.

Show the applicant's hands on that process

Connect the person to the process in verifiable steps: which lines were commissioned, which tolerances were tuned, which failures were diagnosed, which internal work instructions were written or revised. Dates, sites, and named projects matter more than adjectives. Where colleagues share parts of the knowledge, say so, because the standard is not that the applicant is the only person who could do the work. Generic engineering experience, however long, does not substitute for this account. Build the account chronologically from personnel and project records rather than from memory: assignment dates, plant locations, commissioning reports, revision histories on work instructions. That chronology also has to establish one continuous year of qualifying employment with the organisation abroad within the three years preceding the filing, which is a separate requirement from the knowledge itself and is frequently assembled too late.

Set the disclosure boundary before drafting

Decide with the business which technical facts may appear in writing, which may be described only at a level of generality, and which stay out entirely. Formulations, parameter tables, and drawings are usually unnecessary; a description of what those parameters govern and who set them often is not. Agree who approves the final wording. Fixing this early avoids a redrafting cycle in which engineers strike out the very sentences that made the knowledge concrete. Agree a three-tier list in one meeting: written in full, described in general terms, withheld entirely. Put a name against the approval of each tier and a date by which decisions are final. Where a document is withheld, the file can still identify its title, revision number, and custodian, which is often enough to show the process is documented internally without disclosing its contents.

Plan where the work will physically happen

Commissioning often takes place at a plant the employer does not own, or alongside vendors and contract manufacturers. Placement primarily at an unaffiliated employer’s workplace raises specific restrictions concerning who supervises the work and whether the arrangement amounts to labour for hire. Record the site, the reporting line, and who directs day-to-day tasks, and refer that assessment to licensed United States immigration counsel rather than assuming a vendor site is equivalent to a company site. Hypothetical example: a powder-coating operation transfers an employee who set the cure schedule and rework criteria for a coating the company developed itself. If commissioning happens inside the affiliate plant under its own supervisors, the placement question is straightforward; if it happens at a customer site under that customer direction, the offsite restrictions apply and counsel should assess the arrangement before travel is booked. L-1B stays are limited to five years in total.
