APPLICATION ANSWERS · E-2 FIELD GUIDE

Does either route give the family a faster path to settling permanently?

THE DIRECT ANSWER

Neither does. E-2 is a nonimmigrant classification whichever way the business is acquired, and buying a larger or older company does not convert it into permanent residence. Household planning should assume a temporary status tied to the enterprise, with a spouse and unmarried children under twenty-one able to accompany the investor as dependents.

Compare the two routes on family workload, not status

The real household difference is operational. Taking over a trading company usually means long hours immediately, inherited staff and a fixed location; launching from scratch means an uncertain first period with the investor doing everything. Ask which the family can absorb.

If a spouse expects to work, plan that separately — a qualifying E spouse is generally employment-authorized incident to valid status, subject to confirming the actual documentation, while children gain no such authorization. There is one further difference that households consistently underestimate: what happens if the business fails. An acquisition usually comes with obligations that continue, including a lease, employees and supplier terms, while a startup can more often be wound down cheaply if it has not yet committed.

Because the classification depends on the enterprise continuing to operate, that difference reaches the family's status as well as its finances. Ask what each option would cost to exit, and put the answer beside the operational comparison rather than leaving it as an unspoken worry.
