THE SHORT ANSWER

The management consultant entry permits a baccalaureate or licenciatura degree, or equivalent professional experience established by a statement or professional credential showing five years as a management consultant or five years in a specialty related to the consulting agreement. The proposed services must still qualify as management consulting, and the arrangement must comply with TN's self-employment limits.

Establish the qualifying path without over-specifying the degree field

Identify whether the file relies on the baccalaureate/licenciatura degree path or equivalent professional experience. For the experience path, obtain a statement or professional credential establishing five years as a management consultant or five years in a specialty related to the consulting agreement. Supporting letters should explain the dates, work and connection to the arranged services.

Address the employment relationship, not just the consulting label

A consultant proposes to deliver prearranged services to a U.S. client through a consulting corporation. Identify the entity receiving the services, where the business is established, and who owns or controls it. TN does not permit establishing a U.S. business or practice in which the professional is substantively self-employed; services to an entity of which the professional is the sole or controlling owner fall within that restriction. Have counsel assess the actual contracts and ownership structure rather than deciding eligibility from the consulting label alone.

Confirm the engagement is temporary and prearranged

Gather the signed contract or offer letter describing the specific consulting services, the client, the fee or salary arrangement, and the expected end date. A vague or open-ended engagement letter invites questions about whether the position is genuinely prearranged and temporary, rather than an attempt to establish an ongoing U.S. practice.

Watch the self-employment line in a consulting arrangement

This is the category where the structure of the engagement causes more difficulty than the qualification does, because consulting work is habitually organised through the consultant's own company. What the classification is built for is professional work arranged in advance with a U.S. employer; self-employment falls outside it, so an arrangement in which the applicant would in substance be engaging themselves needs examining before anything else in the file is built. Ask four questions and write the answers down. Who is the U.S. entity that will engage the services, and does the applicant or their family own or control it? Who directs the work, sets its priorities, and accepts it as complete? What happens if the engagement is unsatisfactory — who can terminate it, and on what terms? And through what entity would the applicant be paid? Where the answers show a genuine client relationship with an unrelated business, the analysis moves on to the qualifying path and the nature of the services. Where they show the applicant on both sides of the arrangement, no amount of work on the credential or the statement of experience will address it. Hypothetical example: a consultant advising institutions on collection management proposes to contract through their own corporation with a single client, and that structure is the first thing the review examines rather than the last.
