Why doesn't TN cover every skilled occupation?
TN is built around a fixed list of professional occupations under the USMCA, each carrying its own credential requirement. Many skilled trades, even highly specialized ones, simply were not included when that list was negotiated, so they do not qualify regardless of the worker's experience level.
Could L-1B work for a trade role?
It can, if the worker has at least one year of qualifying employment abroad with a company that has a related U.S. entity, and if the role involves specialized knowledge of that company's specific products, equipment or processes rather than general trade skills common across the industry.
Is starting a business a realistic alternative?
For some people, yes. E-2 does not require a listed occupation at all; it requires a genuine, adequately funded business that the applicant will develop and direct. This shifts the question from 'does my job qualify' to 'can I build and fund a viable enterprise.'
What if none of these paths fit right now?
That is a legitimate outcome of an honest review, and it may mean waiting for a different opportunity, gaining different qualifications, or exploring categories outside the six we track here with independent counsel.
