A new operation asks different questions of a transfer file. The knowledge claim still has to be made on its own terms, and on top of it the receiving business must show it can actually put the specialist to work: premises, funding, supervision, and enough activity to need the knowledge. This overview covers what a new operation should have settled before it asks anyone to move. The scenario is presented as an illustration. Hypothetical example: a Port Moody water treatment company has opened a small United States operation and wants to send the technologist who developed its membrane cleaning sequences. Specialized knowledge means knowledge of the organisation's own product, service, research, equipment, techniques, management or other interests, or an advanced level of knowledge of its processes and procedures; length of service alone does not establish it.

Show what the operation is, not what it plans to be

Assemble the ordinary facts of an operating business: secured premises and what work they are suitable for, funding arranged, the qualifying relationship with the parent or affiliated entity, the organization's ongoing international activity, and who will supervise the transferee day to day. A signed lease and a bank account describe capacity better than a business plan does. Where something is still pending, record it as pending rather than describing an intention in the present tense. A short factual description of the site helps: floor area, what equipment is installed, what is on order, and what work can actually be performed there today. That description is checkable against a lease and an invoice, which is precisely why it carries more weight than an adjective.

Explain why a new operation needs this knowledge now

It is a fair question why an office in its first months requires someone with deep knowledge of the organization's own products, services, application, or advanced procedures. Usually the answer is concrete: a system being stood up, a product being brought to a new market, or a process the local team has no way to learn quickly. Write that answer down with specifics, because it also explains what the assignment is expected to produce. The answer should also say what the local team will be able to do once the assignment ends. A transfer that leaves no capability behind invites the question of whether the role is a permanent staffing solution presented as a transfer, so state what knowledge is being moved and over roughly what period.

Check which new-office requirements attach to this category

For an L-1B new-office case, confirm the required premises, qualifying relationship and financial ability to pay the employee and begin doing business in the United States. The specialized-knowledge role must qualify in its own right. Initial new-office L admission is limited to one year. Do not import the distinct L-1A requirement to support a managerial or executive position into an L-1B assessment; plan the appropriate extension evidence with counsel. Note the maximum period of stay as well: L-1B is limited to five years against seven for L-1A, and time already spent in either category counts toward it. A transferee who has held L status before should have that history reconstructed from admission records before the new case is built around a requested period.

Plan for a business that will change quickly

A new operation looks different at month nine than at month one, and the file describes a moment. Decide now who tracks changes to premises, staffing, supervision, and the transferee's actual duties, and agree that material changes go to counsel before they take effect. That habit matters more here than in an established business, because almost everything in the initial description is expected to move. Agree in advance what counts as material: a change of supervisor, a move to different premises, a substantial change in the transferee's duties, or the arrival of local staff who take over part of the knowledge role. Those are the facts an extension request will be assessed against, and each is far easier to record as it happens than to reconstruct a year later.
