USCIS guidance for these categories looks for sustained national or international recognition or work of substantial merit and national importance, evidenced through publications, citations, awards, patents, leadership roles or similar documented achievement, evaluated under specific regulatory criteria.
According to USCIS, the Gold Card program uses Form I-140G to petition under existing employment-based categories, including extraordinary ability and national interest waiver classifications, combined with a registration step and a financial contribution.
As of petitions filed on or after March 15, 2022, the standard investment is $1,050,000, or $800,000 in a targeted employment area or infrastructure project, with a requirement to create at least 10 full-time qualifying jobs, according to USCIS.
It is possible to pursue one route first and keep the other in reserve, but each requires its own dedicated preparation, so most applicants benefit from choosing a primary focus rather than pursuing both simultaneously without a clear reason.
