A filed investor petition grants no status, work permission or right of entry, so occupancy plans cannot rest on it. Family members lawfully present under some other basis remain governed by that basis. Eligible spouses and unmarried children under 21 may qualify as derivatives, but only at the immigrant visa or adjustment stage.
Decide who occupies the property and when
Set out, per person, current status, intended arrival and any schooling or employment need. A house standing empty for years is a cost decision; a house occupied by relatives raises its own tax and status questions worth separate advice. Where a child is nearing 21, ask early how age protection applies on the particular facts, because it is not automatic and can change which household members travel together.
Set out, for each person, what basis they would be present on and when, since an occupancy plan is really a status plan wearing different clothes. A filed petition confers nothing, so a family cannot rely on it to justify living in the property, and a household member already lawfully present under some other basis remains governed by that basis rather than by the investment. Where relatives would occupy the house in the interim, ask about the tax and status consequences separately, because that arrangement is frequently made informally and rarely reviewed by anyone.
