Does working on a new product automatically make the knowledge special?

THE DIRECT ANSWER

No. L1B looks for special knowledge of the employer's product, service, or application, or advanced knowledge of its processes and procedures. Involvement in a launch helps only when the record shows what the person knows about that product and how the assignment uses it. General development skill is not enough.

Connect knowledge to the work assigned

Draft the deliverables first, then write the knowledge each one draws on, then check whether the evidence supports that link. Gaps show up quickly: a deliverable no stated knowledge supports, or knowledge described at length that the assignment never uses. Fix them by narrowing the claim to what the assignment genuinely requires.

The corporate relationship between the entities and the qualifying employment period abroad are checked separately. Two limits deserve stating alongside the knowledge argument. Specialized knowledge is not established by skill or seniority on its own: knowledge common within the industry, or that a competent professional could acquire elsewhere within a reasonable period, generally falls outside it however valuable the employer finds it.

And L-1B stay is capped at five years in total, so an assignment expected to run beyond that needs its next step discussed at the outset rather than in year four. Hypothetical example: a specialist in ballast-water treatment systems knows the applicable standard thoroughly, but the argument rests on the company's own installation methods and its particular retrofit history, not on familiarity with a regulation any qualified engineer could sit down and study.
