FOR PROFESSIONALS · BELCARRABelcarra

Your talent.A bigger stage.

A job title like 'systems engineer' or 'product engineer' does not by itself confirm which USMCA profession applies, and engineering credentials vary by discipline and licensing jurisdiction. This edition works through connecting the applicant's actual day-to-day duties, their specific engineering credential, and the listed profession's requirements before assuming a title alone settles the question. Family, budget, and sequencing considerations follow once that match is clearer.

IN THIS GUIDE · TN review for an engineer whose job title doesn't match the underlying profession

Start with the TN eligibility and application overview

01

Read the duties, not the title

Ask for a paragraph describing what the applicant actually does: designing systems, running analysis, managing a team, writing software, or some mix of these. Engineering titles get applied loosely across companies, and an 'engineer' role can mean anything from hands-on technical design to project coordination with little technical content. Compare that description against the engineering profession's recognized scope rather than the title on the offer letter. If the role leans heavily toward management or sales support, flag that discrepancy immediately rather than assuming the title carries the case.

02

Confirm which specific credential applies

Engineering credentials are not interchangeable across disciplines or jurisdictions; a degree or licence recognized for one engineering category will not necessarily satisfy another. Identify the applicant's specific degree field, any professional engineering licence held, and the jurisdiction that issued it. Where the credential was earned outside Canada or Mexico, or where licensing status is pending, note that as an open item requiring separate review rather than assuming equivalence. This step should happen before the employer finalizes offer letter language describing the position.

03

Reconcile mismatches before filing

When the duties described lean toward management, sales engineering, or a hybrid role, ask whether the offer letter can be rewritten to reflect the technical core of the position more accurately, or whether the position genuinely falls outside the profession. A title change alone will not fix an underlying mismatch between duties and licensing status. Where the applicant's credential is solid but the job itself has drifted from technical engineering work, that is a substantive issue to resolve with the employer, not a wording problem to paper over.

04

Set next steps for the employer and applicant

Ask the employer to confirm the technical proportion of the role in writing and ask the applicant to gather licence and transcript documentation specific to their engineering field. Where licensing status is unresolved, get a timeline for that separately from the TN filing timeline. Build family and moving plans around the more conservative of the two schedules, since a licensing delay or a duty letter rewrite can push the case back further than either party initially expects.

05

Remember the authorization is tied to one employer and one description

A point that rarely appears in the first conversation shapes everything afterwards: the authorization is granted for a particular employer and the position described to the officer or reviewer, not for the applicant generally. That has three consequences worth planning for. A move to a different employer is a new question requiring its own showing, not a matter the applicant and the two companies can settle privately. A material change of duties with the same employer — a promotion into supervision, a shift from technical work into account management, the addition of a second business line — may take the role outside the profession relied upon, so it deserves advice before it is announced. And a second concurrent role with another company is a separate matter entirely rather than an extension of the first. None of this makes the category fragile; it simply means the description in the file has to keep matching reality, and someone should own that comparison after the start date as well as before it. Agree at the outset who reviews the position annually, and ask the employer to notify that person when a reporting line or a job family changes. Hypothetical example: an oceanographer is moved onto a fleet-management team eighteen months in, and because the annual review was diarised the question is asked before the change takes effect rather than a year afterwards.
