Expertise in a commercial platform alone does not establish L-1B. Assess whether the employee has the relevant special or advanced organisational knowledge and whether the US work requires it. The company need not own every underlying product, but ordinary industry skill or a vendor certificate is not a complete eligibility showing.
Point at what the company built
Identify the employer’s implementation practices, service methods, integrations or product applications that the employee understands in depth. Compare that account with the actual assignment and available training and project records. Do not assume that commercial software knowledge is automatically disqualified or that an internal configuration automatically qualifies.
Describe what is special or advanced under the relevant standard, with counsel assessing the evidence as a whole. Two boundaries help keep that description honest. Specialized knowledge does not require that the knowledge be unique, proprietary, or unavailable anywhere else; it requires either special knowledge of the employer's products, services or their application, or an advanced level of knowledge of the employer's processes and procedures.
Equally, it is not established by seniority or by general competence, so an account that would describe any capable engineer with the same years behind them has not yet reached the standard. The productive question is what this organisation does differently and what it took to learn it here. Note also that L-1B stay is capped at five years in total, and prior L time consumes part of that, which shapes whether a long implementation programme is realistic.
Hypothetical example: an engineer who configures a widely licensed platform describes instead the employer's own deployment patterns, its integration layer, and the migration method developed across eleven customer projects, which is a claim about the company rather than about the software vendor's manual.
