Comparing EB-5 and Gold Card after an earlier refusal

THE SHORT ANSWER

A prior refusal changes what both an EB-5 filing and a Gold Card contribution need to address before either is worth pursuing. EB-5 asks for a lawfully sourced, at-risk investment tied to a qualifying enterprise and ten full-time jobs; Gold Card asks for a nonrefundable contribution layered on top of separate EB-1 or EB-2 eligibility and admissibility. Neither route erases the reasons behind an earlier denial, so that record has to be reviewed on its own terms first.

Read the refusal before picking a track

A denial based on incomplete documentation is a different problem from one raising a misrepresentation or admissibility finding. The first can often be cured with a more complete filing under either path. The second can affect eligibility for any future immigrant category, including the underlying EB-1 or EB-2 basis that Gold Card still requires, or the source-of-funds review an EB-5 petition demands. Get qualified review of the actual refusal notice before assuming either route is open. Sort the refusal into one of two kinds before choosing a track. Match the evidence to the chosen category

EB-5 evidence centers on a lawful, traceable source of the $800,000 targeted or infrastructure investment, or $1.05 million standard investment, plus a business plan showing ten qualifying jobs. Gold Card evidence centers on the $1 million individual gift plus the $15,000 per-person processing contribution, alongside proof that the applicant separately qualifies under EB-1 or EB-2 and remains admissible. A prior refusal file should be cross-checked against whichever evidence set applies, not treated as resolved by silence. Hypothetical example: a notice records a misrepresentation finding rather than a shortfall of documents, and the household reads it as a paperwork problem. Get qualified review of the actual notice before assuming either route is open. Where a family member's record was also touched by the earlier decision, that person needs their own review, since derivative eligibility does not survive an admissibility problem simply because the principal's position improves.

Weigh dependents and remaining risk

Spouses and children can be included in either path, but neither guarantees an approval or a filing date, and EB-5 carries conditions tied to job creation that must later be removed. If the earlier refusal touched a family member's record as well, that needs its own review. Treat this comparison as planning information only, not a resolution of the prior case. Cross-check the old file against whichever evidence set now applies rather than treating silence as resolution. One route centres on a lawful, traceable source for the invested capital plus a business plan showing ten qualifying full-time positions, with conditions on residence to be removed later. The other centres on a nonrefundable processing fee and a gift paid by the applicant, alongside proof of separate eligibility under EB-1 or EB-2 and continued admissibility. Neither guarantees an approval or a date.
