An executive appointment to an established US division looks straightforward on an organization chart, yet the decisive evidence is what the person actually does each week. This illustrative planning discussion separates board-level authority from operating routine, so a reviewer can see both. It also covers the ownership relationship, the qualifying year abroad, household arrangements, preparation spending, and the sequence of employer steps that has to follow.

IN THIS GUIDE · Evidencing an executive L-1A appointment to a mature US division by matching governance authority with daily duties

Start with the L-1A eligibility and application overview

01

Anchor the appointment in the qualifying relationship

Before any duty statement is drafted, confirm which entity employed the executive abroad, which entity will employ them in the United States, and how the two are connected as parent, branch, subsidiary or affiliate. Confirm that both remain engaged in regular, systematic international business rather than existing only on paper. Where a division is managed through an intermediate holding entity, map the whole chain, because the reviewer will follow ownership, not the internal branding used on the org chart. Draw the ownership chain from the employing entity abroad to the United States entity, including any intermediate holding company, and attach the document evidencing each link. Internal branding on an organisation chart is not the chain a reviewer follows. Confirm as well that both entities remain engaged in regular, systematic international business rather than existing on paper, because a dormant entity undermines the relationship however clean the paperwork looks.

02

Separate governance powers from operating routine

Signing authority, a board seat and a spending limit describe what the executive may do; they do not describe what fills a working week. Ask for a realistic account of recurring commitments: which leaders report in, what decisions reach this desk rather than being settled below it, and which objectives the person sets rather than receives. Note any hands-on delivery work honestly. An executive-capacity claim rests on discretion over a major function and on supervision that flows through subordinate managers. Ask for a realistic account of recurring commitments rather than a list of powers: which leaders report in, what decisions reach this desk rather than being settled below it, and which objectives the person sets rather than receives. Signing authority and a spending limit describe what may be done; an executive-capacity claim rests on discretion over a major function and supervision flowing through subordinate managers.

03

Test the year abroad against the same standard

The L-1A discussion also looks backwards. Generally one continuous year of qualifying employment with the related organisation abroad, within the relevant preceding three-year period, is expected, and the character of that year matters as much as its length. A promotion partway through the year, a period on a project team, or a stretch spent covering another region should be described plainly. Timing questions of this kind are case-specific and belong with licensed US immigration counsel rather than an internal assumption. Write the year abroad as a dated narrative rather than a start and an end date, describing any promotion partway through, a period on a project team, or a stretch covering another region. Generally one continuous year of qualifying employment with the related organisation abroad, within the relevant preceding three-year period, is expected, and the character of the year matters as much as its length. Refer the assessment to counsel.

04

Decide what the division must produce

Close the planning session with tasks owned by named people: an organisational chart showing the subordinate layer with real headcount, a duty statement written by the leader the executive reports to, evidence of the ownership chain, and a short memo on the year abroad. Agree which of these are already available and which need drafting. Petition approval, visa issuance and admission are separate steps, so keep announcements, start dates and division commitments behind whichever of them is still outstanding. Hypothetical example: an industrial coatings division appoints an executive who also keeps two large accounts personally. That fact belongs in the description rather than outside it, with the proportion of time stated. Close the planning session with named owners for each item: the organisational chart showing real headcount, the duty statement, the ownership evidence, and the memo on the year abroad, and keep announcements behind whichever step remains outstanding.
