IN THIS GUIDE · Coordinating L-2S documentation and household start dates when the family relies on the spouse's earnings
Start with the L-1A eligibility and application overview
Start from the date the second income has to resume
Write down the month the household can no longer manage on one salary, then place every other decision before it. That date determines whether the family travels together, whether the spouse gives notice early, and how much financial runway the move needs. Treat it as a planning input for counsel rather than a deadline anyone can promise, because petition approval, visa issuance and admission are separate steps, each with its own uncertainty and its own evidence. Write two versions of that date: the month the household would prefer, and the month beyond which it genuinely cannot manage. The gap between them is the plan's tolerance, and it is a more useful number than either date alone because it tells everyone how much slippage the family can absorb before decisions have to change.
Understand what L-2S status does and does not do
An eligible spouse admitted in L-2 status and recorded as L-2S is employment authorized incident to that status, so a separate employment authorization document is not universally required. That is a statement about work authorization, not about how quickly an employer's onboarding team will recognise it. Unmarried children under 21 may hold L-2 but are not work authorized by it. Confirm how each person's status is actually recorded rather than assuming the classification followed automatically. It is worth being precise about the sequence. Employment authorization incident to status depends on the person actually holding valid status, which follows admission or an approved change of status rather than the principal's approval notice. A household that treats the approval as the starting gun has usually mis-sequenced its own calendar by several weeks.
Separate immigration records from hiring verification
Keep the family’s relationship records and immigration approvals available for their own immigration process. For US hiring, review acceptable Form I-9 evidence separately: an unexpired L-2S Form I-94 is evidence of employment authorization under List C and must be paired with appropriate List B identity evidence when that combination is used. Employers must follow the Form I-9 rules and cannot impose a universal demand for a marriage certificate or the principal’s corporate packet. Prepare a short factual explanation the spouse can offer a hiring department that has not encountered the category before, and keep it to what the rules actually provide rather than an argument. Most delays at this point come from unfamiliarity rather than disagreement, and a calm one-paragraph account with the relevant document attached resolves the majority of them without anyone escalating.
Decide the household's arrival order deliberately
Families often assume everyone travels at once. Consider instead whether the principal arrives first to secure housing and a bank relationship while the spouse finishes a notice period, or whether a single move costs less and disrupts less. School enrolment dates, coverage gaps and lease start dates all pull in different directions. Whichever order is chosen, make sure nobody's plan assumes work can begin before the relevant status and documentation are actually in place. Whichever order is chosen, write down what would make the family change it, since arrival plans are usually revisited under time pressure and rarely revisited well. A defined trigger, such as a milestone not reached by a stated date, converts that moment into a decision the household has already thought about rather than an argument conducted in a week when everyone is tired.
