Separate the service record from the knowledge claim

Years of service are context, not the eligibility argument. Ask the employee to name the specific systems, product lines, customer configurations, or internal procedures they work with at a depth that ordinary staff in the same job family do not reach. Write that in plain sentences a non-specialist can follow. Where the honest answer is broad familiarity built by time rather than advanced knowledge of the organization's own methods, say so early, while other routes can still be discussed.

Trace where the knowledge was actually built

Knowledge has a history inside the company. Identify the projects, escalations, migrations, or product generations that produced it, and roughly when. A long career often hides the two or three assignments that matter under a decade of routine work. Ask which internal problems this person is called into and why the call goes to them. Those episodes, dated and described, carry more weight than a title held since an early promotion.

Test the description against ordinary experience

Specialized knowledge need not be unique or proprietary. Explain either special knowledge of the organisation’s products, services or other relevant interests and their application, or an advanced level of knowledge of its processes and procedures. These are distinct ways of framing the showing; not every case must satisfy both. Use examples that distinguish the knowledge from ordinary experience and connect it to the proposed assignment, without insisting that every method be unpublished.

Set the evidence request before drafting anything

End the review with tasks rather than conclusions. Decide which manager will describe the role, which records will be pulled, and who confirms the employment history abroad and the receiving entity's relationship to the employer. Note the open questions honestly: an unclear qualifying year, a period on another payroll, a gap nobody can document. A licensed US immigration lawyer decides the strategy; this stage exists to hand that lawyer a complete and accurate picture.

Plan the assignment against its ceiling and its worksite

Two boundaries are worth fixing before the description is drafted. First, L-1B stay is limited to five years in total, which is short enough that an assignment framed as indefinite will collide with it. Decide now whether the intention is a defined transfer of knowledge with a handover to local staff, or an open-ended posting that will need a different answer later. Second, where the employee will spend most of their time at another company's premises, additional conditions apply: the placement must not amount to labour for hire, and the petitioning employer, not the site owner, must retain control and supervision. That question is answered by the actual working arrangements — who assigns the tasks, who conducts reviews, whose procedures govern the work — rather than by a clause in a services contract. Capture those arrangements while they are being negotiated, because renegotiating them later is harder than describing them accurately at the outset. Hypothetical example: a specialist in poultry-house environmental control systems is wanted at three customer sites, and the reporting structure has to be written before the customer contracts are signed rather than afterwards.
