Does leading an established division automatically meet the executive-capacity standard?

THE DIRECT ANSWER

No. Rank, title and ownership stake are not enough on their own. The assessment looks at whether the person directs a major component of the organisation, sets goals and policy, exercises wide discretion, and receives only general supervision. Directing a function rather than staff can qualify where the facts support it.

Write the week down before writing the claim

Ask the executive to keep a plain record of two or three ordinary weeks: meetings chaired, approvals given, budgets set, people hired or promoted, and problems escalated to them. Compare that record with the drafted description. Where the two disagree, the record usually wins with a reviewer.

If much of the week is individual production work, say so early so counsel can assess whether the appointment needs restructuring before anything is filed. Compare that record against the drafted description, and where the two disagree, expect the record to carry more weight with a reviewer. Rank, title, and an ownership stake are not enough on their own; the assessment looks at whether the person directs a major component of the organisation, sets goals and policy, exercises wide discretion, and receives only general supervision.
