The key differences are scale and structure: E-2 has no fixed minimum investment but requires it to be substantial for the type of business and requires the investor to personally develop and direct the enterprise, while EB-5 requires a fixed investment amount, currently $1,050,000 standard or $800,000 in a targeted employment area, and a requirement to create at least 10 full-time qualifying jobs.
There is no automatic conversion between the two, but a founder who starts with an E-2 investment can later file a separate EB-5 petition if the business grows enough to meet the current investment and job-creation thresholds, subject to a full review on its own terms.
No, investors can choose either a designated regional center, which can count indirect job creation toward the requirement, or a direct investment in a new commercial enterprise, which generally must show direct job creation.
