How to compare a temporary work plan against a permanent one

THE SHORT ANSWER

A temporary work category and a permanent immigration path answer different questions and run on different timelines. Comparing them for a household means separating what each family member is authorized to do under each path, not just comparing which one seems faster. It is worth being explicit about what E-2 does not do. The category requires treaty nationality, a substantial investment irrevocably committed and at risk in a real and active enterprise that is not marginal, and an investor who develops and directs it. It confers no permanent residence, and continuing to hold it depends on those conditions continuing to be true rather than on time served.

Compare authorization, not just labels

TN and L-1 authorize the principal's qualifying employment, but the spouse rules differ: TD status does not authorize employment, while a qualifying L-2 spouse is employment authorized incident to valid spousal status without a separate Form I-765 approval. TD and L-2 children are not employment authorized by those dependent classifications. A future permanent-residence plan has separate requirements; compare the family's rights at each actual stage rather than treating temporary status as permanent residence. Set the comparison out per person and per stage rather than per category, since that is the level at which the differences actually bite. The principal's authorization, the spouse's ability to work, and each child's ability to study all change at different points, and a table with a row for each person and a column for each stage shows immediately where the household has a gap. Gaps are the plan's real content; the rest is confirmation.

Separate eligibility from sequencing

Some households treat a temporary category as an automatic step toward a permanent one; the two are evaluated independently, and holding temporary status does not by itself establish eligibility for a green card path such as an employment-based petition or an investor category. Before planning a sequence, each stage's own eligibility should be confirmed on its own terms. Ask specifically what each stage would require if it were started today, since eligibility is assessed on current facts rather than on intentions. An investor route needs capital that exists and is available; an employment-based route needs an employer prepared to act. Where neither is presently true, the honest finding is that the permanent plan is an aspiration rather than a sequence, and the household should make its temporary decisions without assuming it.

Plan for the least certain member first

In a household, the hardest authorization to secure is usually the constraint on the whole plan, whether that is a spouse's ability to work, a child's study status, or the timing of any permanent filing. Map what each family member is authorized to do at each stage before committing to a specific temporary category, and have the sequence reviewed by a qualified professional before relying on it. Hypothetical example: the founder of a sheet-metal fabrication business plans an investor route for herself and assumes her husband, a tradesperson, will simply find work on arrival. A first review would identify that the constraint on the whole plan is his authorization rather than her investment, and would examine it first. It would also confirm who holds treaty nationality and who will actually direct the enterprise, since an arrangement designed around the household's convenience rather than around the operating facts tends to be visible in the documents.
