THE SHORT ANSWER

The social worker entry lists a baccalaureate or licenciatura degree without prescribing the diploma's title. Document a substantive connection between the education and the proposed professional social-work duties. Assess any state licensing requirement separately; the job title alone does not establish either TN eligibility or permission to practise. Two conditions apply alongside the credential. The employment must be prearranged with a United States employer or entity, because the category does not permit an applicant to provide services for their own account, and the applicant must be a citizen of Canada or Mexico. Admission may be requested at a port of entry or through a petition, and the same requirements apply either way.

Assess the education and social-work duties together

Gather the degree and transcript, including relevant social-work coursework and practical training. If the degree has another title, document any significant overlap with the proposed work and ask counsel to assess the fit. Do not assume psychology, sociology or any other degree automatically qualifies, and do not confuse TN credential analysis with state licensing requirements. Where the degree carries another title, the transcript does most of the work. Practicum placements, supervised field hours, courses in assessment, human development and social policy, and any thesis or capstone all show what was actually studied, and they are the material an evaluator or counsel will read. Collect the practicum documentation in particular, since supervised field experience is often recorded separately from the academic transcript and is easy to overlook when a file is assembled quickly.

Check for state licensing overlap separately

An applicant with a social work degree is offered a position at a U.S. social services agency that, per state law, also requires a state social work license to perform certain client-facing duties. Confirming TN eligibility through the degree is a separate question from confirming whether state licensing law allows the specific duties to begin immediately; ask the employer to address both, in writing, rather than assuming the TN document file alone resolves the state licensing question. Hypothetical example: an agency offers a role centred on child-welfare assessment and case planning in a state that regulates that specific activity. Two questions follow, and they have different answers. Whether the applicant meets the listed profession's credential is an immigration question answered from the degree; whether the applicant may lawfully perform the regulated duties from the first day is a state licensing question answered by the regulator. Ask the employer to address both in writing, and ask what the applicant would be permitted to do while any licensing step is pending.

Document duties that match the profession

The employer letter should describe social work duties, such as assessment, case planning, and client services within a social work framework, rather than generic administrative or program-coordination duties. The letter should also name the employer, the worksite, the period of the engagement and the person who supervises the work, since those facts establish that the employment is prearranged and directed by someone other than the applicant. Avoid describing the applicant as an independent contractor or as building their own caseload, because self-employment is not permitted in this category. Where the role genuinely combines social work with programme administration, describe the proportions honestly and take advice on whether the listed profession still fits.
