Comparing EB-5 and Gold Card for a household weighing temporary and permanent plans

THE SHORT ANSWER

A household weighing a temporary work-based stay against a permanent investment route needs to understand that EB-5 and Gold Card are both immigrant, not temporary, paths, and they differ mainly in structure and cost rather than in how quickly either resolves. EB-5 requires a $800,000 targeted or infrastructure, or $1.05 million standard, at-risk investment tied to ten qualifying jobs. Gold Card requires a $1 million contribution plus $15,000 per person, on top of separate EB-1 or EB-2 eligibility. Because both are immigrant routes, the comparison is between two structures rather than between speed and permanence. EB-5 places capital at risk in a new commercial enterprise and depends on that enterprise creating qualifying jobs, with conditional residence followed by a petition to remove conditions. The payment route involves money paid by the applicant to the United States government and returns nothing.

Separate the temporary and permanent tracks

If any temporary work authorization is also under consideration, it should be evaluated on its own terms and not treated as a step toward either investor category; a temporary status does not convert into EB-5 or Gold Card eligibility on its own. Once the household commits to a permanent route, the comparison is between the investment-and-jobs structure of EB-5 and the contribution-plus-underlying-category structure of Gold Card. There is a further reason to keep the tracks apart in the paperwork as well as in the planning. A temporary case is assessed on the intention appropriate to that category, and describing a temporary move as the first step toward settling permanently can raise questions the case did not otherwise present. Keep the documents for each route in its own file, prepared for its own purpose, and let counsel advise on how the two interact rather than blending them in a single narrative.

Plan for every family member individually

Both paths can include a spouse and children, but the cost and documentation differ. Gold Card requires the added $1 million plus $15,000 for each included spouse or child, while EB-5 dependents share in the conditions attached to the principal investor's status until job creation is confirmed. Map out exactly which family members will be included before comparing total commitment between the two routes. Hypothetical example: a household holding the proceeds of a trucking business sale is weighing the two routes and assumes the choice turns on which is cheaper. A first review would ask two prior questions: whether an EB-1 or EB-2 determination is realistically available on this applicant's own record, since the payment route depends on it, and whether the household could commit capital that must remain genuinely at risk for a period it does not control. The answers usually eliminate one route before cost is discussed at all.

Keep expectations bounded by risk

Neither route guarantees approval or a fixed timeline. EB-5 status remains conditional pending verified job creation, and Gold Card still depends on EB-1 or EB-2 availability and admissibility even after the contribution is made. Treat this comparison as a planning framework for the household, not a projection of how quickly either path will conclude. Be specific about where each risk actually sits, since that is more useful than a general caution. On the enterprise route the exposure is job creation and sustained investment, tested when conditions are removed roughly two years into residence. On the payment route the processing fee is spent whether or not the case succeeds, the gift payment is not refundable equity, and the underlying immigrant category has to stand on its own merits. Neither route removes the other's risk; it substitutes a different one.
